Expert Opinions

Expert Opinions.

An Expert Opinion Letter is written by an expert in his/her relevant field, often a university professor. In the Expert Opinion, the expert examines the job and provides his/her opinion and analysis as to whether the job meets the requirements of a specific visa. For example, an expert may evaluate whether a particular job qualifies as a specialty occupation job for H-1B visa purposes. The experts that provide our Expert Opinion Letters are highly-qualified and experienced in their respective fields, usually distinguished university professors. We have experts available in almost every field. If you have a need for expert opinions in a particular field, we will be happy to provide you with information and qualifications of our experts. We provide the following expert opinion services:

1. Specialty Occupation Opinion Letter.
This is a letter, written by an expert in the field, such as a university professor, who examines the job and provides an opinion with analysis, as to whether a particular job qualifies as a specialty occupation job for H-1B visa purposes.

2. Combination Evaluation and Expert Opinion Letter.
This is a hybrid letter which does both, evaluates the candidate’s qualifications for a particular job, and also provides an expert opinion and analysis (from a qualified expert in the field, such as a university professor) about whether the particular job meets the requirements of the visa sought. For example, a commonly used Combination Evaluation and Expert Opinion Letter is one where the professor establishes the qualification of a candidate for a certain job based on educational credentials and work experience, and also provides an opinion and analysis as to whether the job is a specialty occupation - this is a hybrid between an Education and Work Experience Evaluation and a Specialty Occupation Opinion Letter. The Combination Evaluation and Expert Opinion are also used for example in L-1A cases, to evaluate the candidate’s qualifications as a manager or executive and also to establish whether the job is a managerial or executive position.

3. Customized Expert Opinion Letter.
Expert opinion letters may be required for other visa categories, for example, to establish whether an L-1A position is managerial or executive in nature, or whether in an AC21 I-485 porting case, the new position is same or similar to the old position based on which the I-140 was filed. Jobs offered to candidates of various visa categories may require different analysis, based on the regulations of such visa categories and the facts specific to each respective case. The Customized Expert Opinion Letter provides a level of customization to meet these needs by providing the attorney or company the flexibility to work with an unbiased, highly-qualified expert in the field.
